In February 2024, the Lawyers Collective (Anwält:innenkollektiv) filed an urgent application in the name of Palestinians in Gaza, to stop the German’s government approval of war weapons exports to Israel; with the support of ELSC, Law for Palestine, Palestine Institute for Public Diplomacy (PIPD), and Forensis.
In June, the Administrative Court of Berlin dismissed our urgent appeal and concluded that no ban on exports of war weapons would be necessary, assuming that the German government is acting in accordance with international law. But we will not stop here and are planning further legal action!
This is the analysis of our Senior Legal Officer Nadija Samour, who is working on the case with the Lawyers Collective: “The factual assumption for the court’s ruling is highly questionable. The court relied on the facts provided by the government, which we view with caution because the authorization procedures are partly secret. We will now dedicate our resources to prevent Germany from illegally selling weapons in violation of the court’s decision through freedom of information requests, main proceedings, and urgent proceedings based on a case by case finding with regards to specific authorizations of weapons exports once they become known.”
Thank you for your immense support in this case so far. We need your continued support to help in the next phase of this legal action. You can help us by:
- Sharing this Instagram post amongst your network and amplify the case
- Donating further to cover the deficit of EUR 4,045 - we need the movement to band together and show its strength in numbers to help cover the costs of this case and its developments. Funds raised here will be used to cover the high court and lawyer fees amongst other administrative costs related to how the case progresses.
