Unser politisches Ziel ist es, den hinter dieser Resolution stehenden antipalästinensischen Rassismus in Deutschland und die damit eng verflochtene, von Merkel 2008 formulierte (antidemokratische, staatshörige) „deutsche Staatsräson“ anzugreifen.

Das Bundestag 3 für Palästina (BT3P) Team
Wieso die Klage gegen den Deutschen Bundestag?
Seit der Verabschiedung des BDS Beschlusses durch den Deutschen Bundestag im Mai 2019, richten sich faktisch Bundesländer, Gemeinden, sonstige öffentliche Akteure und sogar private Firmen nach dem Aufruf des Bundestages und verweigern oder entziehen in der Praxis BDS-Aktivist*innen und Palästina-Unterstützer*innen öffentliche Räume. Damit verletzt der Deutsche Bundestag und alle involvierten Akteure das Grundgesetz der Bundesrepublik Deutschland, insbesondere die Meinungs-, Kunst- und Wissenschaftsfreiheit (Art. 5 GG) und die Versammlungsfreiheit (Art. 8 GG). Das juristische Ziel der BT3P ist es, die Nichtigkeit und Feststellung der Rechtswidrigkeit des Anti-BDS-Beschluss zu erreichen.
Was ist der aktuelle Stand der Klage?
Im Mai 2020 wurde die Klage beim Verwaltungsgericht Berlin eingereicht. Die Anhörung vor dem Verwaltungsgericht Berlin fand schließlich im Oktober 2021 statt. Die BT3P machten vor dem Gericht klar, dass ihre Menschenrechtsarbeit für Palästina nicht vom Bundestag als „antisemitisch“ diffamiert werden darf. Der Einsatz für gleiche Rechte für alle Menschen in Palästina und Israel kann nicht „antisemitisch“ sein. Das Gericht wies die Klage zwar ab, aber gleichzeitig urteilten sie, dass die Berufung aufgrund vieler ungeklärter Rechtsfragen möglich sei. Das taten die BT3P schließlich auch und beantragten die Berufung vor dem Oberverwaltungsgericht Berlin, wo am 16. Juni 2023 die Anhörung stattfand. Das Gericht wies auch dieses Mal die Klage zurück, aber nur weil es sich nicht für zuständig hielt. Stattdessen sah das Gericht eine grundsätzliche Bedeutung, die vor dem Bundesverfassungsgericht in Karlsruhe geklärt werden müsse. Bevor es allerdings soweit kommt, muss die letzte Instanz auf dem Verwaltungsgerichtsweg, nämlich vor dem Bundesverwaltungsgericht in Leipzig, gegangen werden. Somit wird die Klage zu einem Hürdenlauf, den das BT3P Team aber bestreiten wird, so dass die Repression und Diffamierung von Palästina-Unterstützer*innen in Deutschland ein Ende hat.
Wie gut sind die Erfolgsaussichten?
Das Ziel des Bundestages, die Klage als unzulässig und ohne Klagebefugnis zu bewerten, ist vor beiden Instanzen gescheitert. Das war ein erster Erfolg für die BT3P. Die vielen offenen Fragen, zu denen beide Gerichte nicht urteilen wollten oder konnten, machen uns zuversichtlich, die nächste Instanz zu gewinnen.
Warum soll ich an die BT3P Kampagne spenden?
Juristisch wird es wichtig sein, die Nichtigkeit des Anti-BDS-Beschluss vor Gericht zu erreichen. Gleichzeitig ist es im Zuge der zunehmenden Repression gegen die gesamte Palästina-Solidarität in Deutschland unerlässlich, ein starkes Zeichen zu setzen, dass Menschenrechtsarbeit für Palästina nicht verboten und nicht antisemtisch ist.
Wer steht hinter der Klage und sammelt die Spenden?
Hinter der Klage selbst stehen die 3 Kläger*innen Judith Bernstein, Amir Ali und Christoph Glanz. Allerdings wird die Klage im Namen aller Aktivist*innen der Palästina-Solidarität in Deutschland geführt. Alle Aktivist*innen werden ermutigt, an dieser Initiative aktiv mitzuwirken, so dass zusammen ein rechtlicher und politischer Erfolg erzielt werden kann.
Wie viel Spenden (in EUR) werden benötigt?
Eine Klage gegen den Deutschen Bundestag über mehrere Instanzen, ggf. bis zum Bundesverfassungsgericht, ist eine kostspielige Angelegenheit. Ohne Spenden wird es nicht möglich sein, die BT3P Initiative zu aufrechtzuerhalten bleiben. Es werden insgesamt 15.000€ benötigt.
Wofür werden Spenden benötigt?
Die Spenden werden für Gerichtskosten, Anwaltskosten, Reisekosten zu Gerichtsterminen und Kosten für Presse- und Öffentlichkeitsarbeit benötigt.
Was habt ihr mit den bisherigen Spenden gemacht?
Bisherige Spenden wurden insbesondere für Anwaltskosten und Presse- und Öffentlichkeitsarbeit verwendet. Der Rest der bisherigen Spenden wird zusammen mit neuen Spenden ausschließlich zur Deckung aller Kosten bis zur nächsten Instanz (Bundesverwaltungsgericht Leipzig) genutzt.
Was ist der Mindestbetrag für die Spende?
Es gibt keinen Mindestbetrag. Wir sind über jede Spende extrem dankbar.

Why the lawsuit against the German Bundestag?
Since the adoption of the BDS resolution by the German Bundestag in May 2019, federal states, municipalities, other public actors and even private companies are in fact following the call of the Bundestag and in practice deny or withdraw public spaces from BDS activists and Palestine supporters. In doing so, the German Bundestag and all involved actors violate the Basic Law of the Federal Republic of Germany, in particular the freedom of expression, art and science (Article 5 GG) and the freedom of assembly (Article 8 GG). The legal goal of BT3P is to obtain the nullity and declaration of illegality of the anti-BDS resolution.
What is the current status of the lawsuit?
In May 2020, the lawsuit was filed with the Berlin Administrative Court. The hearing before the Berlin Administrative Court finally took place in October 2021. BT3P made it clear to the court that their human rights work for Palestinians should not be defamed as "anti-Semitic" by the Bundestag. Working for equal rights for all people in Palestine and Israel cannot be "anti-Semitic." The court dismissed the case, but at the same time they ruled that the appeal was possible due to many unresolved legal issues. This is what the BT3P finally did and applied for an appeal to the Berlin Higher Administrative Court, where the hearing took place on 16 June 2023. The court rejected the appeal this time as well, but only because it did not consider itself the right legal body. Instead, the court saw a fundamental importance that would have to be clarified before the Federal Constitutional Court in Karlsruhe. However, before it gets that far, the last instance must be taken through the administrative courts, namely the Federal Administrative Court in Leipzig. Thus, the lawsuit will be a hurdle race, which the BT3P team will fight, so that the repression and defamation of Palestine supporters in Germany will come to an end.
What are the chances of success?
The Bundestag's goal of having the lawsuit ruled inadmissible and without standing failed before both courts. This was an initial success for BT3P. The many open questions on which the two courts did not want to or could not rule make us confident of winning the case ultimately.
Why should I donate to the BT3P campaign?
Legally, it will be important to obtain the annulment of the anti-BDS decision in court. At the same time, in the wake of increasing repression against all Palestine solidarity in Germany, it is essential to send a strong signal that human rights work for Palestine is not forbidden and not anti-Semitic.
Who is behind the lawsuit and collecting the donations?
Behind the lawsuit itself are the 3 plaintiffs Judith Bernstein, Amir Ali and Christoph Glanz. However, the lawsuit is being filed on behalf of all Palestine Solidarity activists in Germany. All activists are encouraged to actively participate in this initiative so that together a legal and political success can be achieved.
How much donations (in EUR) are needed?
A lawsuit against the German Bundestag through several instances, if necessary up to the Federal Constitutional Court, is a costly affair. Without donations it will not be possible to maintain the BT3P initiative. A total of 15,000€ is needed.
What are donations needed for?
The donations are needed to cover court fees, lawyers fees, travel expenses to court dates and public relations costs.
What have you done with the donations so far?
Donations to date have primarily been used to cover legal fees and public relations costs. The remaining amount together with new donations will be exclusively used to cover all costs up to the next instance (Federal Administrative Court).
What is the minimum donation amount?
There is no minimum amount. We are extremely grateful for any donation.

If you ultimately win, this will eliminates a large portion of the costs. What will happen to the donations?
We will invest all excess donations for the following purposes:
- Support legal activities of other campaigns in favor of Palestine solidarity
- Support Palestinian and pro-Palestinian civil society organizations that work in Germany and/or Palestine.
