FGF is participating in the preparation and filing of two amicus briefs being presented to the Supreme Court involving transgenderism. The cases are Bradley Little, Governor of Idaho, et al v. Lindsay Hecox, et al; and the State of West Virginia v. B.P.J., by Next Friend and Mother, Heather Jackson. In the Idaho case, a biological male is challenging the “Fairness in Women’s Sport Act,” enacted by the Idaho legislature in 2020 which requires that only biological females be allowed to compete in interscholastic women’s and girls’ teams in Idaho state schools; and likewise restricts biological males to men’s and boys’ teams. The law is being challenged by a biological male wishing to try out for the women’s cross country and track teams at Boise State University. The West Virginia case is similar. The legislature there enacted the “Save Women’s Sports Bill” in 2021. B.P.J., a biological male who describes himself as a “transgender girl” challenged the law under the Equal Protection Clause and Title IX as he wished to compete on the girls’ track and cross country teams.
