As a New Jersey nonprofit corporation, ROSAH is a private independent charitable organization, not formed by, controlled, or affiliated with the State of New Jersey or any of its agencies or offices. ROSAH was formed on February 12, 2020 as a New Jersey nonprofit corporation with purposes consistent with exempt status as a charitable nonprofit organization. ROSAH’s application for a determination letter from the Internal Revenue Service with respect to status as an exempt organization under Section 501(c)(3) of the Internal Revenue Code is pending. No assurances can be given at this time that a favorable determination letter will in fact be issued. As explained by the IRS, a favorable determination letter is usually effective as of the date of formation of an organization if, during the period before the date of the determination letter, its purposes and activities were those required by law. Membership fees may be used to advocate for affordable housing, open spaces, the environment and natural habitat, preserving a permanent legacy of historic buildings, and the real property rights of taxpayers and affected residents . Membership fees may be used to fund litigation (including fees incurred to date), but is not the primary or even a substantial part of the anticipated activities and purposes of ROSAH.
