#LegalizePsilocybin in New York

Imagine a New York where adults can safely access psilocybin 🍄


NY Bill A 2142 would make psilocybin legally available for adults in New York through permits, health screenings, support services, licensed sales, and at-home cultivation. It is different from any other state so far and more progressive than the bills passed in Colorado and Oregon because it actually allows adults to obtain safe psilocybin products for use in their own homes.


The proposed legislation aims to:

  • Allow adults to obtain a permit to use psilocybin in private homes or other locations, with public use permitted as long as it is not visibly intoxicating (e.g., microdosing).

  • Require a health screening to identify exclusion criteria, either through self-certification or a healthcare provider, and completion of a 5-hour educational course.

  • Legalize optional support services, including paid trip-sitters.

  • Permit home cultivation of psilocybin or purchases from licensed cultivators.
