RELEASE OF LIABILITY READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS In exchange for participation in the activities of Group Excursions at the Animal Based Gathering, Costa Rica (including but not limited to surfing, hiking, snorkeling, swimming, and jumping off the waterfall), organized by Animal Based Nutrition Research Foundation (ABNRF), PO Box 1425, Idaho Springs, CO 80452, I hereby agree to the following on behalf of myself and, if applicable, any other individuals for whom I have purchased or provided tickets (whether family or otherwise). I acknowledge that anyone holding a ticket to this event is bound by this Release, and I assume full responsibility for ensuring that each ticket holder reviews and agrees to its terms. Furthermore, I accept all liability for any consequences arising from a ticket holder’s failure to read, sign, or otherwise acknowledge this Release. 1. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Animal Based Nutrition Research Foundation or its employees, representatives, or agents. 2. ASSUMPTION OF THE RISKS, RELEASE, AND HEALTH REPRESENTATIONS. I represent that I (and, if applicable, my family members or other participants for whom I purchased tickets) am in suitable physical and mental condition, with the necessary skill, training, or experience to safely participate in the above-described activities. I recognize that these activities involve inherent risks, and I assume full responsibility for any personal injury, death, or property damage to myself or my family members and other participants covered by my ticket purchase. I further release and discharge Animal Based Nutrition Research Foundation for any injuries, death, loss, or damage arising out of my or my family’s presence at, travel to, or participation in these activities—whether such activities occur on property owned by the Foundation, at third-party locations, or anywhere else—regardless of whether caused by my own fault, my family’s fault, the Foundation’s fault, or the fault of other third parties. I understand that Animal Based Nutrition Research Foundation or its representatives, in their sole discretion, may determine that I (or any participant for whom I purchased a ticket) am unsuited to participate in one or more activities—whether due to age, physical condition, or any other factor—and may exclude that person from the activity at any time without providing any refund or compensation. If I am registering a minor, I accept full responsibility for assessing whether that child is physically and mentally able to engage in the event’s activities; I will provide appropriate supervision and ensure the child follows all safety instructions. I agree to release, waive, and hold harmless the Foundation, its organizers, and any of its representatives from any liability arising out of the child’s participation, including injury, illness, or other loss. I further acknowledge that the Foundation is not liable for any injuries, damages, or other consequences that occur while an excluded participant is not actively engaged in the activity. 3. INDEMNIFICATION. I agree to indemnify and defend Animal Based Nutrition Research Foundation against all claims, causes of action, damages, judgments, costs, or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family’s use of or presence at the activities organized by Animal Based Nutrition Research Foundation, or from any participants for whom I purchased tickets. 4. FEES. I agree to pay for all damages to any property used in connection with the activities of Animal Based Nutrition Research Foundation caused by any negligent, reckless, or willful actions by me, my family, or anyone for whom I have purchased tickets. 5. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under Colorado law. 6. NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that Animal Based Nutrition Research Foundation has offered to refund any fees I have paid to use its services if I choose not to sign this Agreement. 7. ARM’S LENGTH AGREEMENT. This Agreement and each of its terms are the product of an arm’s length negotiation between the parties. In the event any ambiguity is found to exist in the interpretation of this Agreement or any of its provisions, the parties explicitly reject the application of any rule of interpretation that would lead to a construction either “for” or “against” a particular party based on its status as the drafter of a specific term, language, or provision giving rise to such ambiguity. 8. ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement—whether standing alone or as applied to a particular occurrence or circumstance—shall not affect the validity or enforceability of any other provision or of any other applications of such provision. If any portion of this Agreement is determined to be invalid or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid and enforceable. All remaining provisions of this Agreement shall be enforced to the maximum extent permitted by law. 9. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure. Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation is not successful in resolving the entire dispute or is unavailable, any outstanding issues will be submitted to final and binding arbitration under the rules of the American Arbitration Association. The arbitrator’s award will be final, and judgment may be entered upon it by any court having proper jurisdiction. 10. PHOTO AND VIDEO RELEASE. By participating in activities, events, or programs hosted by Animal Based Nutrition Research Foundation (ABNRF), I grant the Animal Based Nutrition Research Foundation permission to use my likeness in photographs, videos, or other media taken in connection with these activities for promotional, educational, and informational purposes. Specifically: • Permission to Use Content: • I hereby grant Animal Based Nutrition Research Foundation the absolute and irrevocable right and permission to record my image, likeness, voice, and/or performance in photographs, videos, or other media. • I further grant Animal Based Nutrition Research Foundation the right to use, reproduce, edit, publish, display, and distribute these recordings in any and all forms of media, including but not limited to the Foundation’s website, social media platforms, newsletters, marketing materials, or other publications. • Scope of Use: • I understand that these materials may be used to promote the Animal Based Nutrition Research Foundation, its programs, or initiatives, and that they may appear in a variety of formats, including print, digital, and online. • I understand that the Animal Based Nutrition Research Foundation may edit or modify the materials as needed. • I acknowledge that I will not receive any form of compensation for the use of these materials. BY SIGNING, INITIALING, MARKING, OR INPUTTING ANY TYPE OF CHARACTER IN THE SPACE PROVIDED BELOW, AND CLICKING THE “NEXT” BUTTON, YOU ACKNOWLEDGE AND AGREE TO THE TERMS OUTLINED ABOVE. YOU FURTHER UNDERSTAND THAT BY ACKNOWLEDGING THIS RELEASE, YOU VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
