Eligibility. The 2025 Biophilic Leadership Summit Experience Giveaway (the “Giveaway”), sponsored by the Biophilic Institute (“Sponsor”), will award one Winner with two (2) free Full Summit Passes and 3 nights accommodation at the Inn at Serenbe (the “Prize”) to the 2025 Biophilic Leadership Summit. The Giveaway is open only to current U.S. residents who are 18 years or older, and is subject to all applicable federal, state, and local laws, rules, and regulations. Participation in the Giveaway constitutes entrant’s (“Entrant”) full and unconditional agreement to, and acceptance of, these Official Rules and Sponsor’s determinations, which are final and binding in all matters related to the Giveaway. Winning a Prize is contingent upon fulfilling all requirements set forth herein. Data Collection. By participating in the Giveaway, each Entrant agrees to receive email or mail communications from the Biophilic Institute regarding news, exhibitions, programs, solicitations, offers, and more. By entering the Giveaway, Entrant consents to the collection, sharing, and use of data resulting from Entrant’s participation in the Giveaway, as provided in the Internet Privacy Policy of the Biophilic Institute. Promotion Period. The Giveaway begins on July 8, 2024 at 12:00 am ET and ends on September 20, 2024 at 11:59 pm ET (the “Promotion Period”). A completed entry must be received by the end time of the Promotion Period. How to Enter. If, in the sole discretion of Sponsor, any Entry Form violates any law, rule or regulation, or infringes upon the rights of any third party, is inaccurate, illegible, incomplete, or irregular in any way, or otherwise does not comply with these Official Rules, Sponsor may disqualify the Entry. Limit one (1) Entry per person during the Promotion Period. Only those donations of $50 or more received in response to the Giveaway or via an Entry Form will be eligible for the Prize. Prize, Drawing and Notification of Winners. On or about Wednesday, September 25, 2024, one Entrant will be randomly selected from all eligible entries as the Winner of the Prize. Winner will be notified via the email address associated with their Entry. The approximate value of the Prize is $3,700.00. Except where prohibited by law, to accept the Prize, the Winner may be required to sign a publicity release form and provide any additional information that may be required by Sponsor. If required, Winner must return all required documents via email (or as otherwise instructed) within seven calendar (7) days following notification or such Winner will be deemed to have forfeited the Prize and another Winner may be selected. If it is determined that the Entrant is not eligible to receive the prize, in the Sponsor’s sole judgment and discretion, another Entrant will be selected. Delivery of Prize. Upon confirmation that the Winner will attend the Leadership Summit, Winner's name and the name of their guest will be included on the check-in list at the Biophilic Leadership Summit registration table at the Inn at Serenbe on Sunday, March 30th, 2025. Publicity. The Winner may be required to execute a publicity release form which authorizes Sponsor to use their name, voice, and photograph, together with any derivatives thereof, for educational, communication, advertising, marketing, or other trade purposes, in any manner or media whatsoever, worldwide, without notice and without compensation for such use. Release of Liability. BY PARTICIPATING IN THE GIVEAWAY OR ACCEPTING A PRIZE, ENTRANTS RELEASE AND AGREE TO HOLD HARMLESS THE SPONSOR, AS WELL AS THEIR TRUSTEES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND CONTRACTORS (“RELEASED PARTIES”) FROM ANY AND ALL ACTIONS, CLAIMS AND/OR LIABILITIES OF ANY NATURE WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, BODILY INJURY (INCLUDING, WITHOUT LIMITATION, DEATH AND DISABILITY), PROPERTY DAMAGE, AND LOSS OR DAMAGE OF ANY OTHER KIND, ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THE 2025 BIOPHILIC LEADERSHIP SUMMIT EXPERIENCE GIVEAWAY, OR ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE, OR PRIZE-RELATED ACTIVITY, INCLUDING ATTENDANCE AT THE 2025 BIOPHILIC LEADERSHIP SUMMIT. Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Sponsor or Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Giveaway; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Giveaway; (4) technical or human error which may occur in the administration of the Giveaway or the processing of Entries; (5) late, lost, undeliverable, damaged or stolen Entries or email. No more than the stated number of Prizes will be awarded. Cancellation, Suspension or Modification. If the 2025 Biophilic Leadership Summit on March 30, 2025 is canceled for any reason, the Sponsor may select a substitute prize at Sponsor’s discretion. Sponsor reserves the right to cancel, suspend and/or modify the Giveaway, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Giveaway, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner, and to prosecute or cooperate in the prosecution of any such individual, to the fullest extent permitted by law. The use of automated or third party software or websites to participate in the Giveaway is prohibited and resulting entries shall be disqualified. Any attempt by any Entrant to submit more than one entry by using multiple email addresses, identities, registrations, or any other methods, will void such entries and that Entrant may be disqualified. In the event of a dispute, all Entries will be deemed to have been submitted by the owner of the email account used to submit the Entry. For these purposes, the email account holder shall refer to the natural person assigned to the email address by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. Disqualified or ineligible Entrants shall forfeit any awarded Prize. A forfeited Prize may be re-awarded to alternate Winners in Sponsor’s sole discretion. All properly claimed Prizes will be awarded provided a sufficient number of Eligible Entries are received. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Notice of any suspension or modification of the Giveaway or of these Official Rules will be posted on this page. Disputes. These Official Rules shall be construed in accordance with the laws of the State of Georiga, and the venue for any action or proceeding commenced hereunder or in connection with the Giveaway shall be designated in the state or federal courts located in Palmettoa, Georgia.
